Account Setup & Ownership
We will provision your account after payment has been received and verified by our fraud screening systems. It is your responsibility to provide an active, accessible primary email address that is not hosted on the domain name(s) you are registering or hosting under. If an abuse issue arises or emergency communication is required, the primary email address on file in your client portal will be used.
It is your continuous obligation to keep all contact, billing, and technical information up to date. If you register or transfer a domain name through 365eZone, you are responsible for maintaining accurate WHOIS information. 365eZone is not responsible for domain registration lapses or service interruptions resulting from outdated contact details. Providing false, misleading, or fraudulent contact information of any kind may result in immediate suspension or termination of your account.
Account Ownership Designation
The authorized owner of an account is designated as the legal credit card holder or verified owner of the payment account (e.g. PayPal account) used to remit payment. In the event of an ownership dispute, 365eZone reserves the right to require official government identification, proof of payment authorization, or legal documentation prior to releasing or modifying account access.
Website & Data Transfers
Our technical migrations team provides website transfer assistance as a courtesy service. While we make every effort to ensure seamless migrations, we cannot guarantee the feasibility, completeness, or turnaround time of any account transfer.
Because external hosting providers use differing server configurations, proprietary control panels, or incompatible database versions, certain data structures may be difficult or impossible to migrate automatically. Free migration assistance is available within the first 30 days of initial service activation. Migration requests submitted after 30 days may be subject to a customized service quote.
Dedicated IP Address Allocation
All dedicated IPv4 address requests, whether included in specific hosting tiers or purchased as add-ons, are subject to mandatory technical justification in compliance with policies established by the American Registry for Internet Numbers (ARIN) and relevant Regional Internet Registries (RIRs).
365eZone reserves the right to deny or reclaim any dedicated IP request where technical justification is insufficient or current IP utilization thresholds are not met.
Acceptable Use & Content Policy
All services provided by 365eZone may only be utilized for lawful purposes. Customers agree to indemnify, defend, and hold harmless 365eZone from any and all legal claims, liabilities, or damages resulting from the customer's use of our network and server infrastructure.
Intellectual Property & Copyright Compliance
Use of 365eZone services to infringe upon any copyright, trademark, patent, or intellectual property right is strictly prohibited. This includes unauthorized distribution of music, software, literary works, digital media, or photographs. Offering or distributing counterfeit merchandise bearing a registered trademark will result in immediate termination of service. Accounts identified in repeat violations of copyright law will be permanently suspended or terminated without refund.
Prohibited Materials & Server Activities
The following activities, scripts, and content types are strictly prohibited across all shared, reseller, VPS, and cloud hosting servers:
Zero-Tolerance Spam Policy
365eZone maintains an absolute zero-tolerance policy against the transmission of unsolicited commercial email (UCE), bulk email, and spam. "Safe lists", purchased lists, and email scraping/harvesting operations will be classified as spam.
Any account found transmitting spam will be immediately terminated with or without prior notice. Furthermore, websites advertised via spam ("spamvertised"), regardless of whether the emails originated from our network, may not be hosted on 365eZone servers. Any entity listed in the Register of Known Spam Operations (ROKSO) is strictly barred from our network.
Backups & Data Responsibility
Use of 365eZone hosting services is at your sole risk. As a courtesy to shared and reseller hosting clients, our automated backup system generates weekly snapshots, retaining only one rolling week of archives. Each new snapshot overwrites the previous archive.
365eZone is not liable for files, databases, or content residing on your server. You agree to maintain independent, off-site backups of all critical business data at all times.
System Resource Usage Limits
To preserve server stability and equitable performance for all tenants on shared and reseller hosting nodes, users may not:
- Consume 25% or more of available system resources (CPU/Memory) for periods exceeding 90 continuous seconds.
- Execute persistent, unattended server-side background daemons or processes.
- Deploy web spiders, search indexers, or scraping bots on shared hosting environments.
- Run any software interfacing with IRC networks.
- Execute BitTorrent clients, trackers, P2P network software, or distributed file sharing apps.
- Operate game server instances (e.g. Counter-Strike, Battlefield, Minecraft).
- Schedule cron jobs with execution intervals of less than 15 minutes.
- Execute unindexed or unoptimized MySQL queries running longer than 15 seconds.
Monthly Bandwidth Allocation
Each hosting package includes a defined monthly data transfer allocation. If an account exceeds its allocated transfer limit, 365eZone reserves the right to suspend the account until the next calendar billing cycle, apply overage fees, or require an upgrade to an appropriate tier.
Unused bandwidth from one billing month does not accumulate or roll over into subsequent billing cycles.
Cancellations, Refunds & Money-Back Guarantee
365eZone offers an unconditional 7-day money-back guarantee on all new managed shared hosting and Linux reseller hosting accounts paid via Credit Card or PayPal.
Refund Exclusions
- Dedicated Servers, VPS Instances, & Cloud Servers: No full refund is offered; the 7-day money-back guarantee does not apply to server infrastructure.
- Domain Registrations & Transfers: Domain registration fees, ICANN surcharges, and administrative fees are non-refundable.
- Add-ons & Custom Installations: Custom software setup fees, licensing fees, and SSL certificates are non-refundable.
- Repeat Customers: Refund eligibility is limited strictly to first-time customer accounts.
- Terms Violations: Any account suspended or terminated due to a violation of these Terms of Service waives all refund eligibility.
International payment refunds are processed in U.S. Dollars (USD) and reflect prevailing exchange rates on the processing date.
Reseller Hosting Obligations
Reseller account holders are solely responsible for providing customer service, billing, and tier-1 technical support to their sub-clients. 365eZone does not communicate with or provide technical support directly to reseller end-clients.
Standard shared hosting packages (non-reseller tiers) may not be partitioned or resold to third parties. Customers seeking to resell hosting must subscribe to an authorized Reseller, Master Reseller, Alpha Reseller, or Super Alpha Reseller package.
Dedicated & Virtual Server Administration
For dedicated servers and managed infrastructure, 365eZone reserves the right to reset administrative or root credentials if required for emergency security audits, datacenter maintenance, hardware diagnostics, or abuse mitigations.
Price Lock Guarantee & Promotional Coupons
Price Lock Guarantee: The recurring renewal fee you pay for an active hosting subscription will not increase from the date of initial contract purchase, provided your subscription remains continuously active and unmodified.
Promotional discount coupons and voucher codes are reserved exclusively for first-time orders and new accounts unless explicitly designated otherwise. Coupon codes cannot be applied toward domain name registrations or renewals.
Third-Party Products & Services
All commercial transactions with third-party software vendors, payment gateways, or integration partners (e.g. WHMCS, cPanel, SiteLock, SSL Certificate Authorities) are governed by the respective vendor's end-user licensing agreements.
365eZone makes no warranties, express or implied, regarding the availability, features, or uninterrupted performance of third-party goods and services.
Suspension, Termination & Limitation of Liability
365eZone reserves the right to suspend, terminate, or restrict access to any account at any time with or without notice if deemed necessary to protect network integrity or enforce these terms.
Under no circumstances shall 365eZone, its directors, employees, or datacenter partners be held liable for any direct, indirect, incidental, special, or consequential damages resulting from service interruptions, data loss, server downtime, or unauthorized access.
